My weeWeb Terms of Use

When you use services from My weeWeb.com [hereafter referred to as “My weeWeb”] constitutes you acknowledge that you have read the Terms of Use and that you accept, agree and will be bound by the terms hereof and such terms may be modified from time to time.

Account Setup and Email on File

Your account will be set up after we have received payment and our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with a valid email address and to ensure the email address on file is current or up to date at all times. If we need to contact you we will use the primary email address on file to do so. Providing false contact information of any kind may result in the termination of your account.

Ownership

The authorized owner of the account is the credit card holder or owner of the PayPal email address that was used for payment on that account.

Content

My weeWeb may only be used for lawful purposes. The laws of the Province of Alberta and Canada apply.

The customer agrees to indemnify and hold harmless My weeWeb from any claims resulting from the use of our services.

All text, graphics, audio, design and other works on the site are the works of My weeWeb unless otherwise indicated. All rights reserved. All text, content and graphics used in individual weeWebs are deemed to be the property of the individual owners.

Content on the site is for personal use only and may be downloaded provided the material is kept intact and there is no violation of the copyrights, trademarks, and other proprietary rights. Any alteration of the material or use of the material contained in the site for any other purpose is a violation of the copyright of My weeWeb and/or its affiliates or associates or of its third-party information providers. This material cannot be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way for non-personal use without obtaining the prior permission from My weeWeb.

You are prohibited from using our services to infringe upon any copyright or trademark. This includes but is not limited to unauthorized copying of photographs, logos, digital media, or any other copyrighted work. Your account will be terminated immediately if you offer the sale of any counterfeit merchandise of a trademark holder. In addition, any account found to be in violation of another’s copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from My weeWeb. If you believe that your copyright or trademark is being infringed upon, please email info@myweeweb.com with the required information below:

1. The contact details for the owner of the trademark including name, address, telephone number and email address.

2. A statement describing your authority in this matter if you are not the trademark owner.

3. Documentation identifying your valid trademark right and the goods and/or services to which it pertains.

4. A documented example of the trademark use you are objecting to on the My weeWeb hosted customer website. Please provide, as applicable, specific URLs, screenshots or other pertinent documentation.

If the request is of a licensing issue, we may require further documentation.

We reserve the right to refuse service. Based on our judgment, any material that is deemed to be obscene, threatening, pornographic, illegal, or violates our terms of service in any way may be removed from our servers (or otherwise disabled), with or without notice.

All abuse issues will be addressed via email within 48 hours. Failure to respond to our email regarding the abuse issue within 48 hours may result in the suspension or termination of your services.

Users are ultimately responsible for all actions taken under their account. This includes compromised credentials such as username and password. You must use a secure password. Audits will be performed to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password. If you do not change/update your password in a timely enough fashion after notification of a weak password, your account may be suspended until you agree to use a more secure password.

Site Feedback

Any comments, suggestions, proposals or other feedback provided to My weeWeb in connection with the operation or content of this site shall be provided by the submitter and received by My weeWeb on a non-confidential basis. All such comments, suggestions, and other information shall become the exclusive property of My weeWeb. By submitting any such information to My weeWeb, you agree that you are transferring and assigning, at no charge, all of your right, title and interest in the information, including all copyrights and other intellectual property rights. You agree that My weeWeb shall be free to use such information on an unrestricted basis.

Payment & Renewal

You agree to pay My weeWeb in advance of the time period during which such services are provided. PayPal will take your payment through their secure servers. Your weeWeb is subscription based, and therefore is renewed automatically every year by PayPal. As your weeWeb subscription renewal date approaches, email reminders will be sent out by My weeWeb one month prior to your renewal date and by PayPal one week before your renewal date. If you wish to cancel your My weeWeb subscription, cancellation must be received by My weeWeb and PayPal prior to your renewal date. To cancel, please follow cancellation procedures below.

1) Email requesting cancellation can be sent to My weeWeb at info@myweeweb.com. Once we receive your cancellation and have confirmed all necessary information you will be notified of your account closure. No refunds will be given, once payment is made for your account. If payment for renewal has not been made on or before your renewal date, your weeWeb will be removed.

2) Cancel your weeWeb subscription on PayPal. To cancel the automatic payment and renewal of your weeWeb subscription, cancellation can be made through your PayPal account or by calling PayPal for assistance.

My weeWeb reserves the right to change the annual payment amount and any other charges at anytime. For existing My weeWeb customers, the new annual payment amount and any other charges will apply upon renewal.

Data Backups and Loss

My weeWeb is not responsible for files and/or data residing on your account. Our backup service runs once a week, overwrites any of our previous backups made, and only one week of backups are kept. While customer files and data will be backed up as part of our backup service, it is for express use of My weeWeb and is not provided as a service to our customers. You agree to take full responsibility for all files and data transferred and to maintain all appropriate backup of files and data stored on My weeWeb servers. In the event of data loss on our servers, My weeWeb will restore all weeWebs from the most recent backup on our servers. We are not responsible for any missing or updated data residing in your account that was created after the most recent backup. You will be notified of the restore event via email and are wholly responsible to update any missing or updated data at your own cost and discretion.

Cancellations and Refunds

If you wish to cancel your My weeWeb subscription, cancellation must be received by My weeWeb and PayPal prior to your renewal date. To cancel, please follow cancellation procedures below.

My weeWeb reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice for non-payment or violating our Terms of Use policy.

No refunds will be given, once payment is made for your account.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold My weeWeb harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against My weeWeb, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless My weeWeb against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with My weeWeb; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from My weeWeb.

Disclaimer

My weeWeb shall not be responsible for any damages you or your business may suffer. My weeWeb makes no warranties of any kind, expressed or implied for services we, or our clients, provide. My weeWeb disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays and any and all service interruptions caused by My weeWeb, its employees and our customers.

My weeWeb cannot guarantee the website will be available 100% of the time. Although My weeWeb strives to provide the most reliable website possible, interruptions and delays in accessing the website are unavoidable and My weeWeb disclaims any liability for damages resulting from such problems.

Disclosure to Law Enforcement

My weeWeb will disclose, upon lawful request, any account information requested by law enforcement agencies without further consent or notification to the account owner. We cooperate fully with all law enforcement agencies.

Changes to the Terms of Use

My weeWeb reserves the right to revise its policies at any time without notice.
